GUIDELINES REGARDING TRASH CANS AND YARD DEBRIS CONTAINERS

Trash Containers - Are You in Compliance?
We have been receiving an increasing number of questions and complaints about trash containers being left out in plain sight on non-trash days. Trash containers are not things of beauty and they do not add to the appeal of our community. Hopefully, we can all agree on that. The Association’s governing documents address trash containers. Let’s see what they say.
FMEHA Declaration, Article VII Protective Covenants and Restrictions, Paragraph 7
“Trash and garbage containers shall not be permitted to remain in public view except on days of trash collection. No accumulation or storage of litter, new or used building materials or trash of any other kind shall be permitted on any lot.”

“In accordance with the Declaration, trash cans and yard debris containers shall not be put at curbside earlier than the evening prior to the scheduled pickup day and must be removed from curbside on the evening of the pickup day.”
“On non-scheduled pickup days, trash cans and yard debris containers must be shielded or screened from view (i.e., the trash cans or yard debris containers must not be visible to someone standing on ground level outside the property).”
Local Companies.
American Disposal Services and Republic Services provide trash removal services for our community. They have different, but somewhat overlapping pickup schedules. As a result, trash containers are visible curbside almost every day of the week. This tends to complicate the situation.
What Should I Do?
The company you use has schedules for trash, recycling, and yard debris. Put the appropriate container curbside no earlier than the evening prior to the pickup. Put the container out of view no later than the day of the pickup.
What Does “Out of View” Really Mean?
When it is trash day, your trash containers are curbside and clearly visible. On non-trash days, the trash containers should be put away where they can not be seen. Here is a simple test. On a non-trash day, walk or drive by your house. Can you see your trash containers? Are you in compliance?
How Can I Shield My Trash Containers?
There are several ways. You can store the trash containers in your garage or behind your house. You can screen the containers with bushes or shrubbery. Or you may obtain ACC approval to construct a small lattice type of fence. The trash containers can be stored behind the lattice.

Cleaning up after your pet is a neighborly thing to do. It is also a sign of responsible pet ownership. So, please, for the benefit of all, “Scoop it up, bag it, and dispose of it in your own trash can!”
